Introduction

Please read these Terms and Conditions carefully before using www.polar-watches.com operated by LIFE Health & Fitness Club Limited (Company Number: 5303853 and VAT Number: 826370331). By accessing or using our website you agree to be legally bound by these Terms and Conditions.

Prices

Prices listed are in £GBP. All prices include VAT @ 17.5%. All prices and special offers are subject to availability and change. We may change the advertised price of a Product at any time. Delivery costs may vary according to delivery address and country.

Payment

Payment is usually by credit or debit card and is taken when the Order is placed in line with the price featured at the time of purchase and any applicable Delivery charges. This is to protect us from card fraud. The Order will usually be fulfilled within 5 working days but will take no longer than 30 days in extreme cases. You undertake that all details you provide to us for the purpose of purchasing Products or services which may be offered by us on our website will be correct, that the credit or debit card which you use is your own and that there are sufficient funds or credit facilities to cover the cost of any Products or services. We reserve the right to obtain validation and verification of the authenticity of your credit or debit card details before providing you with any Products or services. You can pay for your shopping in a number of ways, whether it is on-line or over the telephone. We accept Mastercard, Visa, Switch, Solo, Delta or Maestro. On-line and telephone order payment is processed via our SSL secure payment system. In the case of card payments, funds are taken at point of order.

Availability

If the Product you Order is unavailable, out of stock or discontinued we may provide you with a substitute of an equivalent quality and price without notice. In the event that we are unable to supply the Product or any Substitute Product to you at all, we shall notify you as soon as possible and shall reimburse your payment in full. We reserve the right not to supply you at our discretion.

Delivery

Due to the nature of external contract Delivery, additional Delivery charges are outside our control and the Company will not be held responsible for such costs. By agreeing to the terms and conditions you are also agreeing to accept additional Delivery charges should your postcode/area necessitate these. You are also agreeing to be bound by all terms and conditions that delivery companies which are associated with us abide by. These can be obtained from the companies own individual websites. Whilst we agree to use all reasonable endeavours to ensure that Delivery is made around the Delivery time advertised, you will acknowledge that actual Delivery is often via third party suppliers and carriers and can therefore be beyond our control. Incorrect personal details may lead to problems or delays in Delivery, so before placing your Order, please ensure that you have included the full address details, including accurate postcode of the Delivery address and your daytime contact telephone numbers and e-mail address so we can notify you in the event of a Delivery problem. Please note, if the order is subsequently cancelled, you will be liable for all carriage charges and a 15% restocking fee.

When Your Delivery arrives

Delivery will be deemed as successfully made once the Product has arrived at the address specified. Signatures are usually required as proofs of delivery but confirmation procedures are ultimately decided by third party organisations. Products will be deemed your responsibility once they have been received by you, your agent or the intended recipient. Any loss or damage to the Products shall then be at your own risk. In case of Delivery to certain locations such as hospitals, airports, hotels, ships and other business premises, the signature of any person authorised to accept Delivery on behalf of the organisation shall be accepted as proof of Delivery. Should Delivery be refused at the Delivery address, and re-requested for another date, we may charge for the second Delivery, since we met our Delivery obligations with the initial Delivery attempt. When the delivering carrier brings your order you MUST count the pieces you receive and look for any damage. The number of boxes you should receive will be noted on the carriers delivery note. If the number of boxes you receive does not exactly match the number of pieces on the carriers delivery note, you MUST note the number of pieces you received on the delivery note by your signature. Damage to the equipment/packaging MUST be noted on the delivery note next to your signature. THE WORDS 'UNEXAMINED' OR 'UNCHECKED' WILL NOT BE ACCEPTED AS A CONDITIONAL SIGNATURE. You MUST cross out 'delivered in good condition' from the carriers delivery note. It is very important to check your order. A signature is an acceptance that you have received the whole order in good condition. Any shortages or damages MUST be reported to www.polar-watches.com by the next working day from signing. Neither www.polar-watches.com nor the carrier can be held responsible for damages if you do not note them on your delivery note.

Cancellations and returns

We endeavour to provide the best Customer Service possible. Should anything go wrong, we will make every effort to resolve the issue. However, should the problem be unsolvable, or you prefer to amend or Cancel your Order, please email us at info@polar-watches.com. If you cancel your order after it has been shipped, you are responsible for any and all freight charges incurred by us, and a 15% re-stocking fee will apply. Any unpaid freight charges will be deducted from your refund. If you refuse to accept delivery of your order for any other reason than the product being damaged in transit, you are liable for all outward and return freight charges incurred by your refusal. If it is found that any of the larger products upon delivery will not fit through any doors/stairwells and the product is subsequently returned/refused, you will be liable for all outward & return carriage costs & a 15% restocking fee will apply. If you are returning a Product for any reason, except damage (informed to us on delivery date) or manufacturer defect, you must pay the costs of returning the Products to Us or our suppliers. All returned products must be completely disassembled and correctly placed in all original packaging.

Refunds

Refunds will be processed within 30 days. Where exchange rates of currency are involved, the Refund will be made in £GBP at the current exchange rate. We do not accept responsibility for any loss or gain caused by changes in the exchange rate between the time of Ordering and the time of issuing the Refund.

We reserve the right to make changes or corrections, alter, suspend or discontinue any aspect of our website or the content or services available through it, including your access to it. Unless explicitly stated to the contrary, any new features including new content shall be subject to these Terms and Conditions. Please note that although we try to ensure that the content of our website is accurate, our websites may contain typographical errors or other inaccuracies. These Terms and Conditions replace all other Terms and Conditions previously applicable to the use of our website and/or sale of the Products. Please note that our website is available only to individuals that can form legally binding contracts under applicable law.   • You must ensure that the Personal Information you provide is accurate and complete and that all Ordering or registration details (where applicable) contain your correct name, address and other requested details. By accepting these Terms and Conditions, you agree to the processing and disclosure of the Personal Information for the Purposes. In addition, the following applies to all messages, emails, ideas, suggestions, concepts and other material submitted by you to us.

When you access any other website you understand that it is independent from us and that we have no control over the content or availability of that website. In addition, a link to any other website does not mean that we endorse or accepts any responsibility for the content, or the use of, such a website and shall not be liable for any loss or damage caused or alleged to be caused by or in connection with use or reliance on any content, Products or services available on or through any other website or resource.
